Enforcing a commercial contract through Botswana's courts costs 39.8% of the value of the claim and takes 660 days (World Bank Doing Business 2020 — final edition; data to May 2019). Break the cost down and the story changes: court fees are 3.3 percentage points, enforcement fees 1.5 — attorney fees are 35. The state is cheap. Counsel is not. Across Sub-Saharan Africa the totals run harder still: enforcing a contract costs 41.6% of the claim against 21.5% in OECD high-income economies, and takes 654.9 days against 589.6 (same series). In Botswana, at least, the bottleneck is not the court calendar. It is the price of legal labour.

So people route around the profession. Across 38 countries surveyed in 2024/25, only 3% of Africans say a lawyer is the first place they would take a legal problem — behind the police at 41% and traditional leaders at 22% (Afrobarometer). Fewer than half — 46% — believe they could afford legal advice; 53% believe help exists somewhere. The belief that help is findable runs ahead of the belief that it is payable, and that gap is where the damage happens: contracts signed unread, disputes settled on the stronger party's terms, small businesses carrying legal risk they have never priced. People act on their legal problems — everywhere except through lawyers, because the lawyer is the one door with a fee on it.
